Short-term and long-term working capital solutions

All services are subject to qualification criteria, lender approval, financial review, and availability. No funding approval or outcome is guaranteed.

4. User Responsibilities

You agree to:

Provide accurate, current, and complete personal and business information

Avoid misrepresentation or omission of material facts

Cooperate in good faith throughout the application, underwriting, and funding process

Any false or misleading information may result in denial of funding, termination of services, or legal action.

5. Fees, Payments, and Repayment

All fees, repayment terms, and funding conditions are disclosed prior to acceptance.

By accepting any financing offer, you agree to the repayment terms stated in your agreement.

Failure to comply with repayment obligations may result in penalties, collections, or termination of services.

6. Confidentiality and Data Protection

We respect your privacy and do not sell personal or business data without consent.

Data is handled in accordance with applicable laws and our Privacy Policy.

Reasonable security measures are used to protect stored information.

7. Messaging Terms & Conditions (A2P / SMS Compliance)

By submitting an inquiry, application, or form through our Website (including application pages), you consent to receive communications via SMS, phone calls, and email, including service-related messages.

Opt-In: By submitting a form or otherwise providing consent

Opt-Out: Reply STOP or UNSUBSCRIBE at any time

Frequency: Messaging frequency will not exceed one message per day

Carriers: Carriers are not liable for delayed or undelivered messages

Cancellation

You can cancel the SMS service at any time. Just text “STOP” to the +1 954-737-7413. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. 8. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including violation of these Terms.

Upon termination, your right to use the Service will cease immediately.

9. Limitation of Liability

To the maximum extent permitted by law:

Fusion Capital FL LLC and its suppliers shall not be liable for indirect, incidental, special, or consequential damages.

Total liability shall be limited to the amount actually paid by you through the Service or $100 USD, whichever is greater.

We are not responsible for delays, disruptions, or failures caused by third parties or circumstances beyond our control.

Some jurisdictions do not allow certain liability limitations; in such cases, liability is limited to the maximum extent permitted by law.

10. “AS IS” and “AS AVAILABLE” Disclaimer

15. United States Legal Compliance

You represent and warrant that:

You are not located in a country subject to U.S. government embargoes

You are not listed on any U.S. government list of prohibited or restricted parties

16. Sever ability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any provision does not constitute a waiver.

17. Translation Interpretation

If these Terms are translated, the English version shall prevail in the event of a dispute.

18. Intellectual Property
